What is Title IX?

Title IX is a federal civil rights law that prohibits discrimination based on sex in educational programs and activities that receive federal funding, including Eureka College. It ensures that all students, regardless of sex, have equal access to education, free from discrimination, in a safe and supportive environment. Title IX addresses various issues including sexual harassment, sex discrimination, and protections for pregnant and parenting students, aiming to create equitable opportunities for all individuals.

How to report

To report sexual harassment or sex discrimination as a student, parent/guardian, employee, or other impacted individual, click below and send the information to the Title IX team:

 

Please use this form to report concerns that may fall under Title IX. This includes:

 

  • Discrimination on the basis of sex
  • Sexual harassment
  • Sexual assault
  • Dating/domestic violence
  • Stalking

 

Submitting this form does not automatically initiate a Title IX investigation. Upon receiving this report, the Eureka Title IX Office will evaluate the information and determine the appropriate next steps, which may include implementing supportive measures and communicating with the involved parties to discuss their options.

Reporter Information

The reporter is the person completing this form. A reporter is the individual who received the concern, observed the behavior, or is submitting the report on behalf of someone else.

 

In most cases, the reporter is not the Complainant. However, if you are the individual who experienced the concerning behavior (e.g., you're reporting something that happened to you), then you may also be listed as the Complainant in the next section.

 

All Eureka employees are mandated reporters under Title IX and are required to report any concerns involving sex discrimination or sexual harassment to the Eureka College Title IX Office.

 

If you're unsure whether the conduct rises to the level of Title IX, it is always better to report it. The Title IX Office will review the information and determine the next steps.


Complainant Information

"Complainant" means an individual who is alleged to be the victim of conduct that could constitute sex discrimination or sexual harassment


Respondent Information

"Respondent" means an individual who has been alleged to be the perpetrator of conduct that could constitute sex discrimination or sexual harassment.


Incident Information

Please share who was involved, what happened, where and when the incident occurred, and how you found out about it. These details will assist the Title IX Office in determining next steps and can facilitate a more timely response.

Sexual Harassment

Sexual harassment includes Quid Pro Quo Sexual Harassment, Hostile Environment Sexual Harassment and the following Specific Offenses:

  • Sexual assault
  • Domestic violence
  • Dating violence
  • Stalking
Sex Discrimination

Inequitable treatment in education activities and programs including, but not limited to, athletics, clubs, educational programs.

Pregnancy Protections

Protections and opportunities for pregnant and parenting students and employees to provide equal access, prevent discrimination, and address disparate treatment.

 

Support

Eureka College’s priority is to provide a safe and supportive environment for students and employees. Students and employees who have experienced sexual harassment or discrimination are provided with non punitive supportive measures regardless of whether they request an investigation.

 

Process

Eureka College follows the process required by Federal Law to investigate and resolve Title IX matters. Our goal is to make this process as simple as possible for both Complainants (individuals who have allegedly been sexually harassed or discriminated against) and Respondents (individuals accused of sexual harassment or discrimination).

Frequently Asked Questions

How do I report a Title IX Concern?

You can make a Title IX report several ways. If you tell a mandatory reporter (Eureka employee) that you are experiencing sexual harassment or other prohibited conduct, they are required to report that information to the Title IX Coordinator. A Title IX Team member will reach out to you to offer resources.
You can also self-report using the form above, or contact one of the members of the Title IX Office listed above to report information.

Can I make a report to Title IX and get assistance with supportive measures even if the Respondent is not affiliated with Eureka College?

YES!

What is a No Contact Order?

A No Contact Order (NCO) is a written directive offered through Title IX. The purpose of the NCO is to stop all communication between two or more parties, with the goal of helping the parties move forward in a supportive and successful way. NCOs are often issued when one party wishes to have no further communication with another party, or when Eureka College determines that two or more people need to have no further communication due to alleged prohibited conduct or other safety concerns. A NCO is not a finding of responsibility, and it does not mean that either party is in trouble. If one party reports a violation of the NCO, school administrators will investigate the report and recommend some type of sanction if it determines a party violated the directive.

Is reporting to Title IX the same as reporting to law enforcement?

No, Title IX is separate from law enforcement. Some reported behaviors may require mandatory reports to law enforcement; therefore the school employee will report the behavior immediately. You may, at any time, report to law enforcement. If there are both law enforcement and Title IX investigations, the investigations will operate separately and simultaneously. law enforcement will collaborate as much as possible and permissible within the law.

What Happens if I'm Accused?

If a formal complaint has been filed and an investigation initiated, you will be provided with a Notice of Allegations against you. This will  include all opportunities and rights for you as a party. You will receive supportive measures throughout the process and the opportunity to  bring an advisor of your choice with you to all meetings
